Travel with Adela
Please read the following carefully. Making payment towards your travel arrangements indicates acceptance of these terms and conditions.
General Booking Conditions
These general terms and conditions together with the relevant terms and conditions of the Third Party Suppliers apply to any travel products/services you purchased through us.
- a) You acknowledge and agree that you have read and understood these general terms and conditions; and any terms and conditions imposed by Third Party Suppliers, for whom we act as an Agent,
- b) Once you pay for your booking (whether in full or in part) you enter into a legally binding contract to acquire the relevant travel or travel related products and/or services with the Third Party Suppliers.
- c) If you make a booking on behalf of someone, you warrant that you have the authority to accept and do accept on behalf of that person to be bound by Travel with Adela’s general terms and conditions and the relevant Third Party Suppliers’ terms and conditions.
- d) You warrant that the information provided to Travel with Adela about yourself, and those travelling with you, is true, accurate, current, and complete.
Agency
Travel with Adela offers for sale to you, various products and/or services on behalf of our Principals such as airlines, other transport operators, hotel and other accommodation providers, tour operators and other principal suppliers. These are referred to throughout as ‘Principals’.
Our services consist of arranging and co-coordinating the services offered by the Principals. Travel with Adela brings about a direct contractual relationship between you, the customer, and each Principal. Subject to these booking conditions Travel with Adela will perform our services with reasonable care and skill.
Travel with Adela does not guarantee the performance of the services offered by the Principals and we will not be liable in the event that you suffer loss, injury or disappointment by reason of any acts or failings of any Principal. In such case your remedy will lie against the Principal.
We reserve the right to cancel or modify itineraries or bookings where circumstances require.
Travel with Adela reserves the right to decline to provide services to any individual.
Legal Contract
When you make a booking with us, legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms and policies and by the conditions of the particular supplier. You must not make any booking unless you understand and agree to all our terms and policies. Once payment is received for a booking, either in part or whole, it is deemed that you have read and understood the terms and conditions for the booking. If you have any queries please contact us before making any booking for any service.
You must read the rules and check the conditions applicable to every component of your arrangements and ensure that you accept those rules and conditions before you make a booking. If the rules and conditions are not displayed you should contact our office.
Once you confirm a booking and make payment you are bound by the rules and conditions applicable to the relevant supplier. You must read the conditions provided by the consultant and ask for clarification if you are not sure of the exact requirements.
We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control.
Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly , by force majeure or any other event which is beyond our control which is not preventable by reasonable diligence on our part.
We are not liable for any claims against non-fulfillment or unsatisfactory fulfilment of products and services purchased on your behalf from third party providers and distributors, such as, but not limited to, airlines, hotels, tour operators, car hire companies, insurance companies, and other entities.
Compensation will not apply if a significant change is made for reasons beyond our control. These include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, pandemics, health risks, changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type; closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, act of government or public authorities or other circumstances amounting to force majeure and/or Acts of God.
Travel with Adela cannot accept liability or responsibility for any airline or supplier bankruptcy or insolvency and the failure to provide any services which may follow.
Pricing
For travel services such as air tickets, hotels, cars, packages or cruises-availability, prices, fare conditions and class of travel can change at any time without notice. Routing restrictions and other special conditions may apply.
Airfares and tour prices may change (almost invariably by being increased) without prior notice and even though your arrangements have been confirmed. Such price increases are beyond our control and you will be liable to pay for any such increases. Many airlines now impose surcharges on the price of air travel. These surcharges may change between the time you make a reservation and the date of full payment.
Fees
Travel with Adela may receive fees, commissions, gifts or financial incentives from third party suppliers under a contract. In addition, Travel with Adela reserves the right to charge Professional Fees for certain bookings and services as reimbursement for travel advisory services.
Credit Card Payment
If paying by credit card, Travel with Adela merchant fees are as follows:
Mastercard (inc. ApplePay & GooglePay) – 1.50%
Visa (inc. ApplePay & GooglePay) – 1.50%
AMEX (inc. ApplePay & GooglePay) – 1.80%
International – 3.00%
All credit card fees are inclusive of GST
Documentation
Check your Itinerary when it is received and check the accuracy of all dates and timings. Ensure that the spelling of the name(s) of travellers match your passport. Any errors on your documents will be your responsibility if not advised to your consultant on the same day that documents are first issued to you.
All times and details included in the itinerary are subject to change without notice. Airlines reschedule flights and make other changes that are beyond our control.
All travel documents are non transferable. The name in which we book your travel must be the same as on your passport. Your booking will be made under this name and changes to name details are not allowed by many airlines and other service providers. Whilst we will do our best to make such a change if necessary, please bear in mind that most airlines and other service providers treat a name change as a cancellation, to which standard conditions and charges would apply.
Cancellation/Refunds
Your contract with your Third Party Suppliers may allow suppliers to cancel or amend bookings. We will ensure that you are promptly notified of any significant changes, but accept no liability for any changes or costs incurred which may result.
Despite anything to the contrary in these general terms or conditions, changes beyond our control to the extent permitted by law, we will not be liable to compensate you in any way, if a significant change is made to your booking for reasons beyond our control.
Cancelled bookings will incur charges. Payments may be non-refundable. We need to receive from you, written notification of cancellation and your original ticket /voucher before any refund can be considered. Even if you decide to cancel arrangements before the balance due date, any payments paid may be non-refundable.
Please note that the terms and conditions for cancellation of bookings and purchases will vary for each product and service. These charges can be up to 100% of the cost of booking, regardless of whether travel has commenced. Fees may apply to all refunds. Travel with Adela reserves the right to charge 10% of your booking as an advisory fee in the case of cancellation, even for refundable booking items.
If your travel arrangements are cancelled for any reason (including force majeure) after you have paid, no refund will be available to you until Travel with Adela receives the monies from the Principal involved. In most cases, the Principal will charge a cancellation fee and in some instances you may not be able to claim a refund.
Travel with Adela is not responsible for any delays by a Principal in processing a refund
If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer. It is recommended that you take out travel insurance at the time of booking.
Passports and Visas
It is your responsibility to fulfil the passport, visa and other immigration requirements for all transiting and stopover destinations applicable to your itinerary. All travellers must have a valid passport for international travel and your passport must be valid for 6 months beyond your return date into Australia. Any fines, penalty payments or expenditure incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
You should confirm requirements with the relevant High Commissions, embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements. Visa requirements vary by both the country you are travelling to and the current citizenship you hold.

Travel Insurance
Travel insurance is a vital part of your travel arrangements. The Australian Government strongly recommends that you have taken out adequate insurance for the duration of your journey. Travel insurance is a mandatory element of some travel arrangements. We can arrange travel insurance for you and can provide you with a quote and answer any queries you may have regarding the insurance we offer. It is recommended that you take out travel insurance at the time of booking.
Health
It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. Vaccinations are strongly recommended for certain destinations. Please contact your local doctor who will advise you of these requirements. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.
Government Travel Advice & Vaccinations
Australian residents should refer to the travel advice posted by the Department of Foreign Affairs at www.dfat.gov.au or www.smarttraveller.gov.au for all the countries you intend to visit. All overseas travellers should register their travel plans with DFAT prior to departing Australia.
Privacy
You have read our Privacy Policy, the terms of which are available on our website or from your consultant, and agree that the terms of such policy are reasonable. You consent to the use and processing of your Registration Data and other personally identifiable user information by the Operator and/or its third party providers and distributors in accordance with the terms of and for the purposes set forth in the Operator’s Privacy Policy. You acknowledge and agree that the technical processing of this site and the transmission of transaction messages relating to the products and services on this site may involve (a) transmissions of your Registration Data and other data collected and maintained by the Operator with regard to you, over various networks and to various countries; and (b) changes to conform and adapt your Registration Data and other data collected and maintained by the Operator with regard to you to technical requirements of connecting networks or devices.
Neither the operator or Travel with Adela will be held responsible for events arising from third parties gaining unauthorised access to such data.
Your Rights under Australian Consumer Law
Nothing in these terms and conditions is to be read as excluding, restricting, or modifying your rights under the Australian Consumer Law and other legislation given to consumers in relation to the supply of goods and services.
